SOCIAL PROBLEMS IN EAST TIMOR - POLICY AND LEGISLATIVE CONSIDERATIONS. METHODOLOGICAL ANALYSES TOWARDS DEMOCRATIC TRANSFORMATION IN EAST TIMOR: RESEARCH REPORTS BY CIVIL SOCIETY

Background: The following reports were produced by 5 East Timorese civil society working groups constituted under the University of San Francisco School of Law Center for Law and Global Justice Legislative Drafting Initiative Program implemented in East Timor in 2003 - 2004 as part of The Asia Foundation's Access to Justice Program. A series of workshops was conducted with representatives from diverse East Timorese civil society organisations who were instructed in the principles and application of the methodolgoy by experts from Universities in the United States and Indonesia.

These civil society representative were organised into 7 working groups corresponding to the 7 Parliamentary Commissions that existed in the First Parliament; namely:

A. Constitutional Affairs, Rights, Guarantees and Liberties;
B. Foreign Affairs, National Defence and Security;
C. Economy and Finance;
D. Agriculture, Fisheries and Environment;
E. Education, Culture, Youth; 
F. Sport, Health, Social Affairs, Labour and Solidarity; and
G. Infrastructure

These reports are based on a legislative drafting methodology known as "Legislative Drafting for Democratic Social Transformation" developed by Seidman et al. Many of these reports were presented to the Commissions of the National Parliament of East Timor in the parliamentary component of the Legislative Drafting Initative. The later reports include draft legislation. Several of these reports were submitted to the relevant Parliamentary Commission in the parliamentary component of the Legislative Drafting Initiative. Some of the Pariamentary Commissions also produced draft legislation under the Legislative Drafting Initiative.

This methodology is sometimes referred to as ROCCIPI which is the acronym derived from the 7 bases upon which the analysis of social problems that are amenable to legislative intervention is made; namely, Rule, Opportunity, Capacity, Communication, Interest, Process and Ideology. The methodolgy is further elucidated in the reports. These reports were written in Indonesian, then translated into English and Portuguese. The reports will progressively be published. (23/09/2008)
